Terms of Service

1. Identity and acceptance

Server5 is software developed and licensed by Xeon Labs. Product, delivery and license enquiries may be sent to xeonlabs.io@gmail.com.

By purchasing, downloading, installing or using Server5, the license holder agrees to these terms. Anyone purchasing for an organization represents that they have authority to bind that organization.

2. Purchase structure

Paddle acts as authorized reseller and merchant of record. The buyer purchases Server5 from Paddle under the Paddle Buyer Terms. Paddle processes payment, determines and collects applicable taxes, and issues the transaction confirmation, receipt or invoice.

These terms form a separate agreement between the license holder and Xeon Labs covering delivery and use of Server5. Xeon Labs does not issue a second invoice for a purchase completed through Paddle.

3. Product description

Server5 provides code, configuration, documentation and automation for preparing and operating supported server environments. The exact deliverables depend on the edition and version available when the purchase is completed.

Published descriptions, requirements, compatibility information and exclusions form part of the product information. References to time savings, performance or simplification are estimates rather than guaranteed outcomes.

4. Editions and eligible use

• Medium: for one individual, one Ubuntu Server host with Docker, and private non-business, non-professional and non-commercial use. It excludes Proxmox, K3s and multi-node expansion.
• Enterprise: for one company, professional, association or organization as the single license holder. It covers servers owned or controlled by that entity and includes the enterprise components described in the offer.

The selected edition must match the actual license holder and use. Medium may not be used for professional, commercial or organizational activity.

5. License grant

After Paddle confirms the purchase, Xeon Labs grants a perpetual, limited, non-exclusive and non-transferable license to use the delivered version within the scope of the purchased edition.

“Perpetual” means the delivered version does not expire merely with time. It does not promise permanent third-party services, infrastructure, future releases, ongoing maintenance or indefinite availability of download links.

6. Restrictions

Unless Xeon Labs gives written permission, the holder may not resell, sublicense, rent, publish, distribute or share the product or access keys; remove proprietary notices; give access to unrelated third parties; bypass edition limits; or use Server5 to create and market a substantially equivalent product.

Enterprise permits internal use by the named entity. It does not appoint that entity as a distributor or permit licensing Server5 to clients, affiliates or other legal entities.

7. Technical requirements and holder responsibilities

Before purchase, the holder must verify that the selected edition matches their hardware, operating system, network access, administrative permissions and technical ability. The holder is responsible for credentials, backups and testing before applying changes to critical systems.

The holder remains responsible for their servers, data, configurations, infrastructure providers and legal compliance. Server5 is not a replacement for security, continuity, monitoring or disaster-recovery procedures.

8. Digital delivery

Delivery begins after Paddle finally confirms the transaction. It may take place by email, download link, repository, archive or another electronic method stated in the confirmation.

The buyer must provide accurate contact details and report access problems promptly. Delivery issues should be sent to Xeon Labs with the Paddle transaction reference, without including full card details.

9. Excluded services

Unless separately agreed in writing, the purchase excludes installation, migration, operations, monitoring, maintenance, consulting, ongoing support, hardware, hosting, remote access, incident response and infrastructure administration.

Future releases, new functionality and adaptations to third-party changes are not automatically included. Additional services require their own scope, price and conditions.

10. Updates and third-party components

The license covers the delivered version. Xeon Labs may release fixes or later versions but is not required to provide them free of charge unless expressly stated.

Server5 may interact with or include third-party software governed by separate licenses. Availability and changes to external services remain outside Xeon Labs’ control.

11. Price, taxes and invoices

Licenses are one-time purchases unless checkout expressly states otherwise. The final price, currency, taxes and payment methods are displayed before the order is placed.

Paddle charges the buyer and issues the applicable tax document in its own name. VAT, exemption, invoice correction and payment-method requests must be addressed to Paddle through the receipt or paddle.net.

12. Conformity and product issues

Server5 must match its description, edition and stated deliverables. If it is not delivered, is corrupted, is the wrong edition or is otherwise non-conforming, the holder should report the issue so the delivery can be investigated, repaired, replaced or otherwise remedied where appropriate.

Nothing in these terms limits mandatory consumer rights concerning digital content that is defective, non-conforming or unfit for a specifically accepted purpose.

13. Intellectual property

Xeon Labs retains all intellectual-property rights in Server5, its code, documentation, designs, marks and materials, except for third-party components. Purchase grants only the license stated here and does not transfer ownership.

14. Suspension and termination

The license may be terminated for a material breach, unauthorized distribution, fraudulent access or unlawful use. Where the breach can reasonably be cured, Xeon Labs may request correction before termination.

On termination, unauthorized use must cease and copies must be deleted unless retention is legally required. Mandatory rights and provisions intended to survive remain unaffected.

15. Warranties and liability

Server5 is supplied as described for the stated compatible environments. It is not guaranteed to operate without interruption across every hardware, network, customization or third-party combination, or to eliminate every risk of server administration.

To the fullest extent permitted by law, Xeon Labs is not responsible for indirect losses caused by external configurations, missing backups, compromised credentials, third-party changes or use contrary to the documentation. No liability is excluded where exclusion is prohibited by law.

16. Changes

Changes apply to future purchases or versions from publication. Terms accepted at purchase continue to govern that license unless a change is required by law, benefits the holder or is expressly accepted.

17. Law, questions and disputes

The Xeon Labs license is governed by Spanish law, without prejudice to mandatory consumer protections in the buyer’s country. Payment, invoicing, withdrawal and refund matters are handled by Paddle under its terms.

Product complaints may first be sent to xeonlabs.io@gmail.com. Disputes are subject to the courts and authorities competent under applicable law.
